Newcastle and Northumberland’s top divorce specialists, Major Family Law commented Sir James Munby, the President of the Family Division of the High Court, called last week for consideration to be given to separating the process of divorce from the resolution of financial disputes on the breakdown of marriage.
The President advocated a “no fault” system of divorce. He called the current process, using grounds of fault for the basis of a divorce “outmoded”, and suggested in uncontested divorce cases divorcing couples should be able to undertake an administrative process in which they would simply record their separation with a registrar of births, deaths, marriage and divorces.
He argued the time had come to separate the process of divorce from the division of matrimonial assets to enable parties to deal with their separation more quickly and with less pain.
